Customs Law and Foreign Trade in Colombia
In foreign trade, the tariff heading decides the margin
A wrongly chosen subheading can change the duty rate, activate or disable a treaty preference, trigger a restriction or a permit requirement, and turn a profitable operation into one that is not. And because the classification repeats on every import, the error is not made once: it repeats until the customs authority finds it, and then it is corrected backwards, with penalties and interest.
Barranquilla is a port city. A large share of the region’s business base lives on importing, exporting or transforming goods, and yet the customs analysis is frequently delegated entirely to the customs broker, who is an operational actor with obligations of its own, not the importer’s legal adviser.
This practice provides preventive and compliance advice in customs and foreign trade, under the customs regulation contained in Decree 1165 of 2019 and its amendments.

Tariff classification and valuation
- Technical classification analysis under the Harmonized System and the Colombian Customs Tariff, supported by the general interpretative rules, legal notes and applicable doctrine.
- Advance ruling applications before the DIAN, which provide legal certainty before importing and are the most underused tool in the regime.
- Review of historical classifications and quantification of accumulated risk, with a recommendation on voluntary correction.
- Customs valuation: determination of customs value under the WTO Valuation Agreement, treatment of relationships between buyer and seller, royalties, licence fees, commissions, freight and insurance, and adjustments to the transaction value.
- Technical defence of declared value during authority controls, before an act is issued.
Origin, trade agreements and customs duties
- Determination and certification of origin under the rules of each trade agreement signed by Colombia, including substantial transformation and regional content criteria.
- Use of tariff preferences and verification that the documentation genuinely supports the benefit, because a poorly supported certificate of origin collapses on verification and the full duty becomes payable.
- Calculation of customs duties: tariff, import VAT and other charges, and their interaction with income tax and creditable input tax. Consistency between the customs and tax positions is coordinated with Tax Planning.
- Trade remedies: exposure analysis for antidumping duties, countervailing duties and safeguards, and support during investigations.
Customs regimes and operations
- Selecting the appropriate regime for each operation: ordinary import, temporary import for re-export in the same state or for inward processing, export, transit, transhipment, cabotage and warehousing.
- Free trade zones: suitability analysis, qualification requirements as industrial, commercial or operator user, investment and employment commitments, and the applicable tax and customs regime.
- Special import-export systems, including programmes allowing inputs to be imported with suspension or exemption of duties against export commitments.
- Bonded warehouses, customs brokers and other users, with review of each one’s obligations and liability regime.
- Authorized Economic Operator (AEO): feasibility assessment, preparation of the authorization process, and alignment of security and compliance requirements across the logistics chain.
Registrations, permits and filings
- Registration and updating of the tax registry with importer or exporter responsibilities and customs user status.
- Filings through the Single Foreign Trade Window (VUCE) and management of permits, approvals and import registrations before the competent authorities according to the product.
- Sanitary, phytosanitary and technical requirements applicable to the goods, and coordination with the relevant authorities.
- Trademark recordal with the customs authority for border measures, a tool against imports infringing industrial property rights. Ownership and registration of the sign are handled by Intellectual Property.
Preventive customs audit
A full review of the company’s foreign trade operation: consistency between invoices, import declarations, transport documents and accounting records; verification of declared subheadings and values; assessment of compliance with commitments under special regimes; and quantification of risk for the open period, with a recommendation on what to correct voluntarily.

Frequently asked questions
My customs broker already classifies the goods. Do I need a lawyer? The customs broker is an auxiliary of the public function with its own obligations, providing an operational service. Responsibility for the information declared rests substantially with the importer. Where the classification is debatable or the value has complex components, it is worth holding an independent legal position and, where appropriate, protecting it with an advance ruling.
What is an advance ruling and why should I request one? It is a determination by the DIAN, issued before importation, on the tariff classification, origin or valuation criteria of specific goods. It provides certainty and binds the authority on the terms of the regulation. For a company importing the same product repeatedly, it is the best cost-to-benefit investment in this entire practice area.
I have discovered I have been classifying incorrectly for years. What now? The first step is quantifying the exposure for each open period and comparing the cost of voluntary correction against the scenario where the authority finds it. In most cases voluntary correction is substantially cheaper. What does not work is changing the classification going forward and hoping nobody looks backwards.
Is operating from a free trade zone worthwhile? It depends on the business model, volume, cost structure and the ability to meet the investment and employment commitments that qualification requires.
